Recent Developments with Personal Jurisdiction in Aviation Accident Products Liability Litigation

Partner Evan Katin-Borland authored an article addressing the unique jurisdictional challenges in aviation accident products liability cases. The issue of personal jurisdiction in these cases often limits a plaintiff’s options, particularly when the manufacturer is a foreign entity headquartered and incorporated outside the United States with no “home” in the country. The article focuses on two key U.S. Supreme Court cases: Mallory v. Norfolk Southern Railway Corp. and Ford Motor Co. v. Montana Eighth Jud.1 Dist. Ct.

Evan Katin-Borland joined Kreindler in January 2012. Named Partner in 2023, Evan currently works on a variety of cases in state and federal courts with a focus on complex products liability cases arising from aviation accidents and other transportation accidents. Evan has been appointed to the Plaintiffs’ Steering Committee for the litigation resulting from the January 2025 midair collision over the Potomac River between an Army helicopter and American Eagle flight 5342. Kreindler & Kreindler represents 34 victims from that tragic incident. He has played an active role in litigation arising from numerous military, general aviation, commercial aviation and train accidents. Evan was one of the lead lawyers in ‘Lofgren v. Polaris Industries’ and is also heavily involved in the firm’s representation of former NFL players and their families in claims through the NFL Concussion Settlement Program.
