Kreindler Of Counsel Gretchen Nelson Wins $1.8 million Verdict in Favor of Connecticut Physician

After three weeks at trial, a jury in the Superior Court of California, in Alameda County, returned a $1.8 million verdict in favor of a Connecticut physician whose royalty contract had been terminated by a company that manufactured and sold a shoulder positioner for arthroscopic surgery. In reaching its verdict, the jury found that the company had breached its contract with the physician and further that the company violated a California statute, Civil Code Section 3344, by failing to pay royalties during a period when the company was using the physician’s name to sell the products.
Gretchen Nelson, the senior partner in the firm’s Los Angeles office, represented the physician and was the trial lawyer on the case.
